1. Who you're contracting with

Mud Master is a software service operated by Marc A. McMahon (sole proprietor), referred to here as "we," "us," or "Mud Master." By creating an account, accessing, or using the service at this website (the "Service"), you agree to these Terms & Conditions.

2. Acceptance

By continuing to use the Service you confirm that you accept these terms. If you don't agree, don't use the Service. If you're using the Service on behalf of a company, you confirm that you have authority to bind that company. You must be of legal age to form a binding contract in your jurisdiction.

3. The Service

Mud Master is a jobsite collaboration tool for concrete crews: voice-driven pour reports, materials and yardage tracking, daily PDF reports, real-time chat, and a calculator tool-kit. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you've subscribed to.

4. Acceptable use

You must not, and must not allow others to:

  • Use the Service for unlawful, fraudulent, or abusive purposes;
  • Send spam, malware, or content that infringes third-party rights;
  • Probe, scan, scrape, or otherwise interfere with the security or integrity of the Service;
  • Reverse-engineer, decompile, resell, or redistribute the Service;
  • Circumvent technical limits or usage quotas.

You're responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information that you keep up to date.

5. Your content

You keep ownership of the data and content you submit to the Service (voice clips, photos, transcripts, pour data). You grant us a limited, worldwide license to host, process, transmit, and display that content solely as needed to provide and improve the Service for you and your crew.

6. Intellectual property

We retain ownership of the Service and its underlying software, documentation, and branding. Nothing in these terms transfers any of our IP to you beyond the limited license to use the Service.

7. Fees, billing, and subscriptions

Mud Master is currently free to use while in beta. When paid plans are activated, subscriptions will be offered on a recurring basis (e.g., monthly or yearly) at the prices shown at checkout. Fees are charged in advance for each billing period and renew automatically until canceled. You can cancel at any time from the customer portal; access continues through the end of the paid period and no further charges are made. Applicable taxes may be added based on your location.

8. Payment processing

Payments are processed by Stripe, Inc., a PCI-compliant payment processor. When you subscribe, your card information is collected and stored by Stripe — we never see or store your full card number. By submitting payment information you agree to Stripe's Terms of Service. Refund eligibility is described in our Refund Policy.

9. Service level & warranties

We work hard to keep the Service available, but we don't guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where the law prohibits such limitation.

11. Indemnity

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these terms.

12. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, suspected security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may export your data on request within a reasonable period before deletion.

13. Governing law

These terms are governed by the laws of the United States and the State where Marc A. McMahon is resident, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction.

14. Assignment & changes

You can't assign these terms without our written consent. We may assign them as part of a merger, acquisition, or sale of our business. We may update these terms; we'll post the new version here with a new "Last updated" date. Continued use after changes means you accept them.

15. Force majeure

We're not responsible for failure or delay caused by events beyond our reasonable control, including outages of upstream providers, internet outages, or natural events.
